Privacy Policy
1. Introduction
This Privacy Policy explains how CheckMy.Music ("we," "us," or "our") collects, uses, and shares personal information when you use the CheckMy.Music website, APIs, reports, and related services (the "Service"). It should be read together with our Terms of Use. CheckMy.Music is a business-to-business service intended for professional users, and this policy is written accordingly.
2. Information We Collect
- Account & contact information — such as name, email, company, role, and billing details you provide when you register, purchase, or contact us.
- User Content — the audio tracks, files, and metadata you upload for analysis, and the reports generated from them.
- Usage & device data — log data, IP address, browser and device information, and how you interact with the Service.
- Cookies and similar technologies — information collected as described in Section 11.
- Payment information — handled by our third-party payment providers; we do not store full payment-card numbers.
3. Your Audio Uploads — How We Handle Tracks
When you upload a Track, we process it to run our analysis pipeline and generate your report. As stated in our Terms, you keep all rights in your User Content; we do not claim ownership of it, and we do not sell it. We store Tracks and reports only as long as needed to provide the Service and as described in Section 8.
We may create de-identified, anonymized, or aggregated data derived from Tracks and from use of the Service to develop, train, benchmark, and improve our models, detection methods, and analytics. Such data does not identify you and is not used to reconstruct or redistribute your original recordings. Enterprise terms may address this separately.
4. How We Use Information
- To provide, operate, and maintain the Service and generate your reports.
- To authenticate accounts, secure the Service, and prevent abuse.
- To process payments and manage subscriptions.
- To communicate with you about support, service updates, and — where permitted — marketing.
- To improve and develop the Service, including through de-identified data.
- To comply with legal obligations and enforce our Terms.
5. Legal Bases for Processing
Where the EU/UK GDPR applies, we rely on: performance of a contract (to provide the Service); our legitimate interests (to secure, improve, and promote the Service); your consent (where required, for example certain cookies or marketing); and compliance with legal obligations. Where we rely on legitimate interests, we balance them against your rights and freedoms.
6. How We Share Information
We do not sell personal information. We share it only as follows:
- Service providers and subprocessors who help us run the Service — for example, cloud hosting, music-recognition and catalog providers, analytics, and payment processors — under appropriate contractual protections.
- Professional advisors such as lawyers, auditors, and accountants, where necessary.
- Authorities or others where required by law, or to protect the rights, safety, and property of CheckMy.Music, our users, or the public.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets.
A current list of subprocessors is available on request.
7. International Data Transfers
We may process and store information in countries other than your own, including in countries where we and our service providers operate. Where we transfer personal data internationally, we use appropriate safeguards, such as Standard Contractual Clauses or other legally recognized mechanisms.
8. Data Retention
We retain personal information and User Content for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements, after which we delete or anonymize it. You may request deletion as described in Section 10; residual copies may remain in backups for a limited period before being overwritten.
9. Security
We use reasonable technical and organizational measures designed to protect personal information and User Content. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please notify us at hello@checkmy.music if you believe your account or data may have been compromised.
10. Your Privacy Rights
Depending on where you are located, you may have rights under laws such as the EU/UK GDPR, the California Consumer Privacy Act (CCPA/CPRA), and Brazil's Lei Geral de Proteção de Dados (LGPD) — including the right to access, correct, delete, or port your data, to object to or restrict certain processing, and to withdraw consent. To exercise your rights, contact us at hello@checkmy.music. If you are an end user of one of our business customers, please contact that customer directly; we will assist them as a processor where applicable. You also have the right to lodge a complaint with your local data-protection authority.
11. Cookies and Similar Technologies
We use cookies and similar technologies to operate the Service, remember your preferences, and understand how the Service is used. You can control cookies through your browser settings; disabling some cookies may affect functionality. Where required, we provide a cookie notice and consent controls.
12. Children
The Service is intended for businesses and professional users and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will take steps to delete it.
13. Third-Party Links and Services
The Service may link to or integrate with third-party websites and services that have their own privacy practices. We are not responsible for those practices, and we encourage you to review their privacy policies.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated version with a new effective date and, where required by law, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the updated policy.
